Police arrest unmasked attendee as maskless group shows up ...

Police arrest Kate Bossi, a Sunday School teacher and grandmother was arrested because she entered the government taxpayer funded school board meeting without wearing a mask. The police were accused of enforcing school district policy instead of law.

 

What is going on here? Across the country Moms and Dads—citizens—concerned for the welfare of their own children and grandchildren are being arrested at government sponsored public school board meetings. And why? For refusing to wear a mask, for refusing to sit down, for refusing to stop talking about topics and subjects the school boards don’t want discussed in public forums. And isn’t that what school board meetings are supposed to be for?

And the topics at the taxpayer funded school board meetings run the gamete from critical race theory, masks on children in school, transgender agenda in schools, pornography targeted at children in schools, and much more.

On top of that, Law enforcement are increasingly being asked to enforce unconstitutional and tyrannical mandates and policies against citizens who have determined that they have no need to wear a mask, sit down when told, or talking during their allotted time at the school board meetings across the country. Unfortunately, most cops are complying with the unlawful requests.

Regardless the reason whether for a perceived pandemic, or other reasons where the state, or any governmental entity demands or requires their permission through a license of any sort in violation of the US Constitution, that law, statute, ordinance, mandate, executive order, etc., is void according to the Supreme Court of the United States (SCOTUS).

The term in law is Ab initio or “from the beginning”. In law, it refers to a thing being true from its beginning or from the instant of the act, rather than from when the court declared it so. Yes, you may have to prove it in court, but when found unconstitutional somebody pays for violating your unalienable rights.

The masking of Americans and the prohibition of “right to movement” into School Board meetings, government buildings, etc., seems to be a violation of a basic and fundamental right to travel unimpeded when there is no injured party.

In the 1969 US Supreme Court decision Shuttlesworth v. Birmingham, SCOTUS ruled stating:

“Persons faced with an unconstitutional licensing law which purports to require a license as a prerequisite to exercise of right… May ignore the law and engage with impunity in exercise of such right.” Shuttlesworth v. Birmingham 394 U.S. 147 (1969).

 

Police arrested a grandfather who dared protest transgender policies at a government taxpayer sponsored Loudon County School Board meeting this past summer.

Any and all licensing laws are permissions granted by the state or a governmental entity. Anyone who is not in commercial trade is not liable to licensing laws.

It is recorded that Benjamin Franklin said “Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.” His words ring prescient more than 200 years later.

In contrast Dr. Anthony Fauci chilled many Liberty minded and thinking American’s when he said: “Put aside all of these issues of concern about liberties and personal liberties and realize we have a common enemy…”

The idea of putting away personal liberties threatens to end the American experiment. The fruit of that concept from Dr. Fauci was very apparent in the Gwinnett County school board meeting November 25th shown below on the Twitter post.

The court also ruled that “Ignorance of the law does not excuse misconduct in anyone, least of all in a sworn officer of the law.” In re McCowan (1917), 177 C. 93, 170 P. 1100.

“Under our system of government upon the individuality and intelligence of the citizen, the state does not claim to control him/her, except as his/her conduct to others, (injured party) leaving him/her the sole judge as to all that affects himself/herself.” Mugler v. Kansas 123 U.S. 623, 659-60.

Clearly, law enforcement officers in the video are in violation of long established laws to protect the rights of citizens guaranteed by the US Constitution. What law was broken? Who was the injured party? There is no law to require anyone to wear a mask in violation of their personal liberty. The courts are having lawsuits due to this fact now.

 

The woman above was arrested at a tax payer funded government sponsored public school meeting in Gwinnett County, Georgia, last week. Her crime? Not wearing a mask in violation of school district ‘mask mandate’. She had also refused to wear a mask during the October school board meeting. She was arrested for violation of school district policy.

 

In America, citizens here don’t serve at the pleasure of governor’s, mayor’s, or elected officials. Rather, citizens are not required to do or not do anything that is not prescribed in the law, and the litmus test is whether or not it is not in violation of the Constitution. Mandates, executive orders and the like are not law, regardless how well meaning or good they may appear.

Again, we must turn to the US Constitution and court rulings on what the law actually means:

Those who have the right to do something cannot be licensed for what they already have right to do as such license would be meaningless. City of Chicago v Collins 51 NE 907, 910.

Also cited in the above case was People v. Battle:

Persons faced with an unconstitutional licensing law which purports to require a license as a prerequisite to exercise of right… may ignore the law and engage with impunity in exercise of such right. People v. Battle, 50 Cal. App. 3, step 1, Super, 123 Cal. Rptr. 636, 639.

 

State and Federal elected officials typically deliberate and pass laws in an orderly fashion whether we like them or not. But, unconstitutional laws are null and void on the face, and as ruled on by the Supreme Court, these unconstitutional laws may be ignored.

Thomas Jefferson warned Americans long ago that you cannot remain ignorant of the law and events taking place around you and expect to remain free. Freedom comes from knowledge and exercising your unalienable God given rights which are secured and guaranteed by the US Constitution. Jefferson also said that “The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants. It is it’s natural manure.”
